OFFICIAL CONTEST RULES

1. Station reserves the right to modify the details of the contest at any time.

2. Each contestant will be required to sign a release form before his or her prize will be awarded. Contestants will be responsible for all applicable title fees, registration fees, and taxes including state, local and federal, and therefore must present a valid Social Security Card before claiming prize.

3. This game is open to persons at least 21 years of age who are legal residents of the United States of America. Only one qualifier per household. Employees of station/company, other related sponsors and all employees of any radio or TV station in the broadcast market and their immediate families cannot participate and are not eligible to win. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.

4. There is no purchase necessary to enter or win the contest.

5. As prizewinners, contestants acknowledge that the station has the right to, without further authorization, publicize contestant’s name, character likeness, photograph, voice, and the fact that contestant was a prizewinner for promotional purposes without financial remuneration.

6. There will be no substitution of prizes. Failure to collect prize within 30 days constitutes forfeiture of the prize. If forfeited, the prize remains the property of the station. Another winner will not be selected.

7. The decision of station management in the interpretation of these rules is final. By participating, persons agree to be bound by the decisions of the judges and the official rules. The decision of the judges is final.

8. If the winner is found in violation of these rules, he/she may be required to forfeit his/her prize.

9. Individuals participating in this contest promoted on or entered thru any station Facebook page release Facebook of any liability or further claims. Participants also acknowledge that this contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. Information collected by the station for entry into this contest is not provided to Facebook.

10. Station is not responsible for any liabilities arising directly or indirectly from the award or use of the prize.

Sandals Resorts – Remote Prizing Terms & Conditions 2025

For 96.9 HITS FM Station

Unique Travel, Corp, the worldwide representative for Sandals Resorts will provide:

(1) One (1) prize consisting of 4-day/3-night All-Inclusive vacation for two (2) adults to any one of the Sandals Resorts listed below, (recipient’s choice) (“Sandals Resorts Accommodations”) plus round-trip coach airfare tickets for two (2) adults through American Airlines to the destination (“Airfare”) (Sandals Accommodations and Airfare collectively, the “Sandals Prize Package”).

1.1 Sandals Resorts include:

1.2 Average Retail Value Sandals Prize Package:
(i) Sandals Resorts Accommodations = US$2,994; and.
(ii) Airfare for two (2) adults = US$1,000 (capped at $500 per person).

Total Average Retail Value Sandals Prize Package = US$3,994.

1.3 The Sandals Prize Package is subject to availability and certain blackout dates including but not limited to days pre and post all major US holidays.

1.4 The Sandals Prize Package will be issued in the form of a prize certificate (the “Prize Certificate”), outlining the terms and conditions of the Sandals Prize Package and redemption procedures.

(2) STATION 96.9 HITS FM:

(i) shall confirm that Unique Travel Corp is the Sandals Prize Package Provider only;

(ii) will provide JAWW Media+ Marketing (“JAWW”) with the name of the winner of the Sandals Prize Package so that JAWW can arrange for the Prize Certificate to be issued.

(iii) will provide JAWW with a copy of the station’s release form and the winner’s W-9 Form.

(iv) is responsible for distributing the W-9 Form to the Sandals Prize Package recipient.

(v) shall inform the Sandals Prize Package recipient that reservations (resort accommodations and flights) will not be confirmed until 30 days prior to the selected travel date.

(vi) will ensure that the Sandals Prize Package recipient confirms and represents that he/she has complied with all the rules and regulations of the promotion/sweepstakes where the Sandals Prize Package is offered and/or awarded, and that he/she has met all eligibility requirements of the promotion/sweepstakes to receive the Sandals Prize Package.

(vii) will ensure that the prizewinner, his/her heirs, executors, administrators, and assigns, hereby waive, and release any and all rights, claims, and causes of action whatsoever he/she may have against the Sandal Prize Package Provider now or in the future arising out of his/her participation in the promotion and/or acceptance and utilization of the Sandals Prize Package that he/she has won, or the exercise of any rights granted herein.

(3) Any federal, state and/or local taxes applicable to the Sandals Prize Package will be the prizewinner’s responsibility to pay. Sandals Prize Package recipient will receive from STATION96.9 HITS FM and/or its designee an IRS Form 1099 (or similar) in the amount of the Sandals Prize Package. Neither Sandals Prize Package Provider, nor any of its affiliates and JAWW shall not provide any IRS Form 1099 or similar tax form.

(4) The Sandals Prize Package must be redeemed for travel within one (1) year from the Prize Certificate is issued and is not transferable or redeemable for cash. No extension will be given after the Sandals Prize Package has expired. If the Sandals Prize Package is not redeemed, the Sandals Prize Package will be forfeited.

(5) The Prize Certificate will outline the terms of the Sandals Prize Package and redemption procedures will be provided at the conclusion of the promotion and upon receipt of proof of performance, for example (where applicable):

o recorded spots / live air checks / interviews
o affidavits
o ROS
o screen shots of promo web page, email blasts and Social Media postings
o On-air Reach
o Total number of social media posts
o Online Impressions

STATION96.9 HITS FM shall abide by all spam laws regarding any and all emails and email blast sent. STATION96.9 HITS FM further agrees to indemnify, defend and hold harmless, Unique Travel Corp, its subsidiaries, affiliated companies and their directors, officers, employees, agents, successors, assigns and any supplier mentioned within an email sent from and against all liability, damages, loss, cost or expense including but not limited to reasonable legal fees and costs, arising out of or in connection with the failure of STATION96.9 HITS FM to comply with, the violation of or the alleged violation of the Can-SPAM Act for U.S. based emails or the Canadian Anti-Spam Legislation (“CASL”) for Canadian based emails or addresses and all other laws and/or regulations regarding emails.

o Opt-ins:

All promotions with an ‘opt-in’ component in favor of Sandals Resorts must have a stand-alone message and an “unchecked box” must be provided to invite the entrants/participants in the promotion to receive commercial electronic messages about Sandals Resorts.

ALL Opt-ins provided by STATION96.9 HITS FM shall consist only of the names, email addresses, country and Opt-in Time Stamp of individuals who expressly opted in to receive email communications from Unique Travel Corp and/or Sandals Resorts and that for the purposes of this section, a recipient will only be considered to have expressly opted in to receive email communications from Unique Travel Corp and/or Sandals Resorts if they took an active step to affirmatively agree to receive such communications and Unique Travel Corp and/or Sandals Resorts was specifically identified at the time consent was given.

STATION96.9 HITS FM shall further agree to maintain and retain adequate proof that each lead expressly opted in to receive email communications from Unique Travel Corp and/or Sandals Resorts, which proof must consist, at minimum, of records showing the manner in which such consent or express opt-in was obtained, and the time that such consent or express opt-in was obtained.

Only the opt-in information for entrants/participants who have provided “express consent” shall be sent directly to https://www.sandals.com/leadgen/ filling out the required fields as indicated.

FOR SANDALS PRIZE PACKAGE RECIPIENT

THE PRIZE

1. One (1) prize consisting of 4-day/3-night All-Inclusive Vacation for two (2) adults to any one of the Sandals Resorts listed below, (recipient’s choice) (“Sandals Resorts Accommodations”) PLUS round-trip coach airfare tickets for two (2) adults through American Airlines to the destination (“Airfare”) (Sandals Accommodations and Airfare collectively, the “Sandals Prize Package”).

1.3 The Sandals Prize Package is subject to availability and certain blackout dates including but not limited to all major US holidays.

2. The Sandals Prize Package will be issued in the form of a prize certificate (the “Prize Certificate”) outlining the terms and conditions of the Sandals Resorts Prize Package and redemption procedures.

3. Sandals Resorts is an All-Inclusive romantic, adults-only resort destination exclusively for couples only. The Sandals Prize Package recipient and travel companion must be 18 years of age or older.

4. The Sandals Prize Package must be redeemed for travel within one (1) year from the Prize Certificate is issued (“Sandals Prize Package Redemption Period”) and is not transferable or redeemable for cash. No extension will be given after the Sandals Prize Package has expired. If the Sandals Prize Package is not redeemed, the Sandals Prize Package will be forfeited.
5. The Sandals Prize Package includes:

(i) Luxurious accommodations: one (1) room double occupancy, king size bed in a deluxe category room, all meals, unlimited premium brand liquors, daily & nightly entertainment, an array of land and water sports activities, including daily scuba diving (for certified divers), snorkeling, Wi-Fi in all rooms and public areas, resort taxes, resort gratuities, and Sandals Resorts transfers to and from the resort’s designated airport.

(ii) Flights: Round-trip coach airfare for two (2) adults valid to/from the nearest major U.S. gateway of the prize winner to the selected or designated resort’s airport. The tickets are valid for the Sandals Prize Package Redemption Period (the “Redemption Period”). Flights will be on mutually approved dates. Winner and travel companion must travel on the same itinerary, originating from the same airport. Flights and airlines are subject to change and availability. Restrictions and blackout dates are 14 days before and after any major U.S. Holiday.

6. “Exclusions” – car rental, personal charges, incidentals, telephone calls, Premium Wi-Fi, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, room services, meals outside of the selected and/or designated resort, island departure taxes, purchases made at the Sandals Specialty or Gift Shops, baggage fees and customs duties are not included.

7. The Sandals Prize Package must be redeemed for travel during the Sandals Prize Package Redemption Period and is not transferable or redeemable for cash. No extension will be given after the Redemption Period has expired. If the Prize is not redeemed, the Prize will be forfeited.

8. Reservations will not be confirmed until 30 days prior to the selected travel date.

9. Any federal, state and/or local taxes applicable to the Prize will be the Sandals Prize Package recipient’s responsibility to pay. The Sandals Prize Package recipient will receive from the station or its designee an IRS Form 1099 (or similar) in the amount of the Sandals Prize Package.

10. SUBSTITUTION OF RESORT. The accommodations portion of the Sandals Prize Package is subject to space availability and selected blackout dates. Unique Travel Corp, the worldwide representative for Sandals Resorts (the “Sandals Prize Package Provider”) and Sandals Resorts each reserves the right to relocate any confirmed prizewinner from the selected resort to an alternate resort within the resort’s chain and to change dates with prior notice should circumstances so require or for any circumstance(s) beyond the resort’s control. The terms and conditions agreed to by the prizewinner shall apply with equal applicability to any resort which is the subject of substitution or deviation. Neither Unique Travel Corp nor Sandals Resorts shall be liable for any claim made by the prize winner whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

11. COMPLIANCE WITH GOVERNMENT ENTITIES. Unique Travel Corp, the Sandals Prize Package Provider, its affiliates, and parent as well as Sandals Resorts and/or Sandals Resorts related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of receipt of the Prize Package or any agreement entitling the prize winner to assert any claim for liability, compensation or refund.

12. HEALTH & SAFETY: The health and safety of our guests is a priority. Sandals Resorts reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law..

13. CLASS ACTION WAIVER: ACCEPTANANCE OF THE SANDALS PRIZE PACKAGE PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT UNDER AS A RESULT OF THESE TERMS AND CONDITIONS. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST UNIQUE TRAVEL CORP WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST’S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS AVAILABLE HERE https://www.sandals.com/terms-conditions/, THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS. GUEST AGREES THAT THE PARTIES REFERENCED IN FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS THAT MAY BE THE SUBJECT OF ANY CLAIM BY GUEST CAN RECEIVE IMMEDIATE JUDICIAL ASSISTANCE TO ENFORCE THIS CLASS ACTION WAIVER.

14. Travel Safety Warning

(i) Due to the fact that travel and tourism are constantly in a state of flux, prizewinner is advised to consult the U.S. State Department’s website at <travel.gov> and enter the name of the country(ies) that they plan to visit for the latest information concerning traveler safety, security, and health advisories.

(ii) All guests are responsible for checking the travel and entry protocols for the destination that they are travelling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, some destinations, may require guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre and post travel. All guests are advised to visit the travel.gov website before travel and to check the official Government website for the country they are visiting. Neither Unique Travel Corp and/or Sandals Resorts shall not be responsible for any additional costs incurred for any required test or any other pre-travel requirements.
